Statutory Liability & Livestock Security (England & Wales)

1. Statutory Awareness

Under the Dogs (Protection of Livestock) (Amendment) Act 2025, the maximum fine for livestock worrying is now unlimited.

2. Road & Path Liability

Legal liability extends to:

  • Public roads

  • Paths

  • Tracks

A Strict Lead Policy will be enforced wherever livestock are present or may be moved.

3. Forensic Consent & Indemnity

Police may seize a dog for:

  • DNA sampling

  • Mouth impressions

The Client agrees to indemnify the Walker against court-ordered costs relating to:

  • Seizure

  • Forensic testing

  • Detention

Unless caused by the Walker’s gross negligence.

4. Owner Exemption

The Act may exempt the Owner from criminal liability if the dog was in professional charge.
However, financial detention costs remain a civil liability of the Client.

Important Clarification

This indemnity covers third-party costs (such as police detention or forensic fees).

It does NOT remove the Walker’s own statutory criminal liability under the Dogs (Protection of Livestock) (Amendment) Act 2025.

We may refuse dogs unsuitable for home care, including:

  • Bitches in season or coming into season

An emergency contact must be provided.

This contact must:

  • Be able to collect the dog if required

Late Return by Owner

If you cannot return on the agreed date:

  • Contact us immediately

If we cannot extend the stay:

  • Your emergency contact will collect the dog

  • If unavailable, the dog will be placed in kennels

  • All costs are payable by you

If no communication is received within 7 days after the agreed collection date, we reserve the right to re-home the animal.

If We Cannot Fulfil Our Obligation

If unforeseen circumstances prevent us from providing care:

  • You or your emergency contact will be contacted

  • A refund will be issued (minus services already received)

  • Alternative care may be arranged at your expense

Short Periods Alone

In rare cases, dogs may be left alone for short periods.

If you do not wish this (except in emergencies), please state this clearly at booking.
